Welcome to Busted Words. These Terms of Use (“Terms”) govern your access to and use of the Busted Words website, game, features, content, and related services (collectively, the “Service”). The Service is operated by Else Mode, LLC (“Busted Words,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.
The Service is intended for a general audience and is not directed to children under 13 years old. You must be legally capable of entering into these Terms. If you are under the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian.
Do not create an account or provide personal information if you are under 13. If we learn that we collected personal information from a child under 13 without appropriate parental consent, we will take reasonable steps to delete it.
Some features require an account, currently created using an email address. You agree to provide accurate, current information and to keep it updated.
You are responsible for maintaining the confidentiality of your account and for activity occurring through it. Notify us promptly at legal@bustedwords.com if you believe your account has been accessed without authorization.
Public display and promotional use. By creating an account, you agree that we may publicly display and publish your username, your gameplay information—including scores, streaks, rankings, achievements, boards played, words found, and progress—and any feedback or other User Content you submit through the Service. That display may appear on the Service itself and in promotional, marketing, or editorial material we publish elsewhere, including on third-party social media platforms. Section 5 describes the license this grants. We do not publish your email address or IP address.
We may suspend, restrict, or terminate accounts that violate these Terms, compromise the Service’s integrity or security, or create risk for Busted Words or other players.
Subject to these Terms, Busted Words grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful, non-commercial entertainment purposes.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, scrape, or exploit any portion of the Service except as permitted by law or with our prior written permission.
Busted Words may offer game scores, streaks, achievements, rankings, leaderboards, and sharing features. These are provided for entertainment only and have no cash value or other monetary value. The Service does not offer prizes, sweepstakes, contests, or rewards with cash or other value unless we expressly publish separate official rules for a specific promotion.
You may not manipulate, falsify, automate, artificially inflate, or interfere with scores, rankings, leaderboards, game outcomes, or other players’ experience. Prohibited conduct includes using bots, scripts, exploits, unauthorized software, coordinated cheating, or attempts to bypass gameplay or security controls.
We may investigate suspected violations and may remove or correct scores, rankings, content, or accounts in our discretion. We do not guarantee that leaderboards, scores, progress, or other game data will always be available, accurate, retained, or recoverable.
The Service may allow you to submit, create, upload, transmit, or share content, including usernames, gameplay information, game-related content, feedback, and other materials (“User Content”). You retain ownership of your User Content, subject to the license you grant below.
You grant Busted Words a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, adapt, display, publicly perform, distribute, and otherwise use User Content to operate, improve, promote, secure, and provide the Service.
That license expressly includes publishing your username, gameplay information, and feedback—on the Service, and in promotional, marketing, or editorial material we publish on other platforms, including third-party social media services, in formats including text, images, and video. We may edit or excerpt User Content for length, clarity, or format. We are not obligated to credit you beyond your username, and we do not publish your email address or IP address in promotional material.
If you would rather your username or feedback were not used this way, email legal@bustedwords.com. You can also change your username at any time in your account settings.
You represent that you have the rights needed to submit your User Content and that it does not violate law or another person’s rights. Do not submit content that is unlawful, defamatory, threatening, harassing, hateful, sexually explicit, infringing, deceptive, or otherwise objectionable.
We may—but are not required to—review, remove, restrict, or preserve User Content at our discretion.
You agree not to:
The Service, including its software, game mechanics, designs, text, graphics, logos, trademarks, word lists, audiovisual elements, and other materials, is owned by or licensed to Busted Words and protected by applicable intellectual-property laws.
“Busted Words” and associated logos or branding may be trademarks of Else Mode, LLC. You may not use them without prior written permission.
If you provide ideas, suggestions, or feedback about the Service, you grant us the right to use it without restriction or compensation to you.
The Service may rely on or link to third-party services, including hosting providers and sharing platforms. We do not control third-party services and are not responsible for their content, availability, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.
The Service currently does not charge fees and does not process payments. If we introduce subscriptions, purchases, advertising, premium features, or other monetization in the future, we may provide additional terms, notices, and payment policies before those features are offered to you.
We may modify, suspend, discontinue, or remove any part of the Service at any time, including game modes, features, scores, accounts, leaderboards, or content. We are not liable for changes, interruptions, or discontinuation of the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BUSTED WORDS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY GAME DATA, SCORES, PROGRESS, OR USER CONTENT WILL BE PRESERVED.
TO THE FULLEST EXTENT PERMITTED BY LAW, ELSE MODE, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, BUSTED WORDS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) US $25.
You agree to defend, indemnify, and hold harmless Else Mode, LLC and its owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction and venue of those courts.
We may update these Terms from time to time. We will post the updated version on the Service and revise the effective date. Your continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms.
